Why accident investigations are essential to your case

Car accidents can leave people emotionally shaken in addition to their injuries. Part of getting over the trauma of a crash (both the emotional and physical) is finding answers to what caused the accident so that you can put it behind you.

With some accidents, the cause is very straightforward. One driver is clearly negligent, and the failure to use reasonable care caused the crash and the ensuing injuries. However, the cause of other accidents may not be so clear cut and an investigation is necessary.

Because of this, questions must be asked to see if the cause of an accident was purely driver error, or whether a mechanical defect played a major role in the crash. For instance, in a rear-end collision, it may be assumed that the driver who hit the other car was at fault. However, a further investigation may reveal that the vehicle was supposed to be under a recall notice for braking issues, but the driver was never notified. As such, the driver may not necessarily be at fault.

The same could be said with trucking accidents. While it may seem like a driver would be at fault for a crash, an investigation into the safety logs may reveal that inspectors may have warned the trucking company about safety hazards that needed to be corrected before the truck went on the road. As such, the trucking company could be held liable for the crash instead of the unsuspecting driver.

Ultimately, an investigation may be necessary to determine the true cause of a crash and who could be held at fault. If you have questions about accident investigations, an experienced personal injury attorney can help.
