Unbelievable tragedies can befall totally innocent victims because of a motorist’s careless or reckless driving. That is the case in a horrendous accident that occurred in Texas recently at the Wimberley Farmers Market when a local folk artist was struck by a car that jumped the sidewalk and plowed into a crowd at the fair. The victim suffered serious injuries that reportedly resulted in the amputation of her right leg.
The offending car apparently pinned her up against another vehicle that was parked. A Facebook post seemingly authorized by the victim and her family reported that the leg was “beyond repair” but that she was nevertheless in good spirits and doing well. The Texas Department of Public Safety indicated that investigators believe that the driver confused the gas pedal for the brake.
Other victims of the bizarre event were also taken to a hospital in Austin, but no further facts were available. The authorities verified that the investigation is ongoing. At this point, it does not appear to be a case of impairment or alcohol but is more in the way of an extremely unfortunate bout of misperception and loss of focus by the driver.
The victim is an actress and a member of the “Trishas,” a Texas folk and country band. She is entitled to make a claim for her permanent and serious injuries. In this case, there may be extensive compensatory damages for pain and suffering, loss of the pleasures of life, lost wages or profits and permanent loss of earning capacity over the remainder of her life.
