Motion To Revoke Probation

If you or a loved is currently on probation or on deferred adjudication (community supervision) and are facing a Motion to Revoke Probation (MTRP/MTR) or a Motion to Enter an Adjudication of Guilt, you need an experienced attorney. We are available 24/7. We understand the seriousness of your case and have the experience to handle your case. We want to help you defend your rights and protect your freedom.

Motion To Revoke Probation (MTR)

The consequences of an MTR are serious, and you could be facing time in jail or prison. In Texas, you have limited rights during an MTR hearing. You do not have a right to have a jury trial, and the state does not have to prove that you violated your probation beyond a reasonable doubt. However, before your probation is revoked, you are entitled to a hearing, wherein we can defend the allegations against you.

Our experience allows us to explore and defend the alleged violations that were committed while on probation. There are options at your hearing other than the revocation of your probation. Available options include, but are not limited to, extending the term of your probation, ordering additional fines, counseling, boot camp, drug or alcohol counseling, and terminating your probation.

If you are on probation for a felony or misdemeanor and a Motion to Revoke Probation (MTR) or to Enter an Adjudication of Guilt has been filed against you, call us immediately. You need an experienced attorney to defend your rights.

Most MTRs do not have a bond set; therefore, as soon as you hire us, we will determine if you are eligible to bond out of jail pending your probation hearing. In most cases, as part of our legal representation, we will post the bond at the courthouse prior to your arrest or at the jail if you are already in custody.

Simultaneously, we will investigate the terms and conditions of your probation and the alleged violations. We will discuss with you what you need to do at that point to present your case to the judge in the best way possible. We will also confer with and subpoena any possible witnesses that will testify on your behalf regarding the issues at hand.

The attorneys at Vela & Del Fierro, P.C., will also confer with your probation officer and the assistant district attorneys in an attempt to resolve the MTR without any jail or prison time. If a hearing is necessary, we will be prepared to aggressively defend your freedom. We will seek the withdrawal of the MTR, the termination of your probation, or alternative sanctions or penalties.
